Pre-launch notice: Secure It Fresh is currently in pre-launch. These terms govern waitlist sign-ups and partner registrations. Full consumer terms will be updated upon service launch.

1. Acceptance of terms

By accessing or using the Secure It Fresh website, mobile application, or any related service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding contract between you and Secure It Fresh Ltd ("Secure It Fresh", "we", "us"). Our Privacy Policy is incorporated by reference.

2. The service

Secure It Fresh operates a tamper-proof food delivery platform connecting consumers, restaurant partners, and courier partners. The platform provides:

  • A marketplace to discover and order from participating restaurants
  • Smart-seal bag technology integrated with our mobile application
  • Real-time order tracking and tamper-event logging
  • Waitlist and early access registration (pre-launch phase)

We act as an intermediary. The contract for food preparation is between you and the restaurant. The contract for delivery is between you and the courier (or with Secure It Fresh where we employ couriers directly).

3. Accounts and eligibility

Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction)
  • You must have legal capacity to enter into contracts
  • You must not have been previously banned from the Service

Account security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at security@secureitfresh.com if you suspect unauthorised access.

We may suspend accounts that show signs of fraud, abuse, or violation of these Terms.

4. Orders and payment

Placing orders

Orders placed through the platform constitute an offer to purchase. Acceptance occurs when the restaurant confirms the order. Prices are set by restaurants and may vary.

Payment

  • Payment is taken at order confirmation via our payment processor
  • Service fees and delivery fees are displayed before checkout
  • Promotional codes are subject to their own terms and cannot be combined unless stated

Refunds and cancellations

  • Orders may be cancelled within 2 minutes of placement for a full refund
  • After preparation begins, refunds are at our discretion
  • Tamper events detected by our seal system are automatically logged and may trigger automatic refunds
  • If your order arrives damaged or incorrect, contact support within 24 hours
Refund decisions involving tamper seals are final once reviewed by our automated system and a human agent. Video evidence from our seal logs is retained for 30 days.

5. Restaurant partners

Restaurants joining the platform agree to:

  • Maintain current food hygiene certifications and comply with all applicable food safety laws
  • Use only Secure It Fresh approved tamper-evident bags provided by us
  • Accurately represent menu items, allergens, and ingredients
  • Maintain preparation and handoff quality standards set out in the Restaurant Partner Agreement
  • Not tamper with or defeat the smart-seal system

Commission rates and payment terms are governed by the separate Restaurant Partner Agreement signed at onboarding.

6. Courier partners

Couriers operating on the platform agree to:

  • Not open, tamper with, or damage sealed bags during transit
  • Maintain all required licences, insurance, and legal permissions to deliver in their operating area
  • Accept and properly handle returned bags under our sustainability programme
  • Operate within the conduct standards in the Courier Partner Agreement

Couriers who breach seal integrity rules face immediate suspension and potential legal action.

7. Prohibited conduct

You must not:

  • Attempt to reverse-engineer, clone, or interfere with our smart-seal technology
  • Use the platform for fraudulent orders, chargebacks abuse, or resale
  • Scrape, crawl, or extract data from the platform without written permission
  • Impersonate other users, restaurants, or Secure It Fresh staff
  • Post false reviews or engage in review manipulation
  • Attempt to access accounts, systems, or data that are not yours
  • Use the platform to violate any applicable law or regulation

Violations may result in immediate account termination and referral to law enforcement.

8. Intellectual property

All content on the Service — including logos, UI designs, copy, the smart-seal system design, and software — is owned by or licensed to Secure It Fresh. You receive a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

You may not copy, distribute, modify, or create derivative works without our written consent. "Secure It Fresh", our logo, and "Sealed · Fresh · Yours" are trademarks of Secure It Fresh Ltd.

9. Limitation of liability

To the maximum extent permitted by law:

  • The Service is provided "as is" without warranties of any kind
  • We are not liable for the quality, safety, or legality of food prepared by restaurant partners
  • Our total liability to you in any 12-month period shall not exceed the greater of £100 or the total fees you paid us in that period
  • We are not liable for indirect, consequential, incidental, or punitive damages

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any matter that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold Secure It Fresh, its officers, employees, and partners harmless from any claims, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

You may delete your account at any time via account settings or by emailing hello@secureitfresh.com.

We may suspend or terminate your access without notice for material breach of these Terms, fraudulent activity, or if required by law. We will provide notice where legally required.

On termination, your right to use the Service ceases immediately. Sections 8, 9, 10, and 12 survive termination.

12. Disputes and governing law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Before bringing a legal claim, we encourage you to contact us at hello@secureitfresh.com — most issues can be resolved quickly without formal proceedings.

If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform.

13. Changes to these terms

We may update these Terms. For material changes, we will provide at least 14 days' notice by email or prominent in-app notice. Continued use after that date constitutes acceptance of the updated Terms.
